Maryland HB 115 creates a private cause of action for individuals whose rights have been violated under the Maryland Declaration of Rights and Maryland Constitution to sue law enforcement officers and agencies. The bill eliminates the defense of qualified immunity and provides for attorneys fees. It requires law enforcement agencies in Maryland to indemnify officers (with certain exceptions).
